Terms of Service

These terms are an agreement between you and GILDARTZ PLT (202604001542 (LLP0046777-LGN)), a limited liability partnership registered in Malaysia ("Gildartz", "we", "us"). By using any of our Services you agree to them. If you do not agree, please do not use the Services.

1. The Services

These terms apply to gildartz.com and every product we operate, including their websites, web apps and Android and iOS apps: Kidz, Waku, Boss, Prcl, PTA, Billz, SpyProp and Linopot (the "Services"). A product may have additional terms, such as pricing, plan limits or marketplace rules. Where it does, those terms apply together with these. If they conflict, the product's terms win for that product.

2. Your account

  • You must give accurate information and keep it up to date.
  • You are responsible for keeping your login details safe and for all activity on your account. Tell us straight away if you think someone else has used it.
  • You must be at least 18, or have permission from a parent or guardian, to create an account.
  • If you register on behalf of an organisation, such as a school, condo management or business, you confirm you are authorised to bind it to these terms.

3. Acceptable use

You must not:

  • break any law, or infringe anyone's rights, including privacy and intellectual property rights;
  • send spam or unsolicited messages, including through Waku or any other messaging feature. You must have the recipient's permission to message them;
  • post content that is false, misleading, hateful, harassing, sexually explicit or harmful to children;
  • sell or list items that are illegal or prohibited;
  • try to access accounts or data that are not yours, disrupt the Services, or get around their security or usage limits;
  • copy, resell or reverse-engineer the Services, except where the law allows.

If you use Waku or other WhatsApp features, you must also follow WhatsApp's Business and Commerce Policies.

4. Your content

You keep ownership of the content you post or upload. You give us a non-exclusive, worldwide, royalty-free licence to host, store, display and process it only as needed to operate and improve the Services. You are responsible for your content, and we may remove content that breaks these terms or the law.

5. Payments

  • Prices, plans and fees are shown in the relevant product before you pay. Unless stated otherwise they are in Malaysian Ringgit (RM).
  • Payments are processed by third-party payment providers, and their terms also apply.
  • Subscriptions renew automatically until cancelled. You can cancel at any time, and the cancellation takes effect at the end of the current billing period.
  • Fees already paid are not refundable, except where the product's terms or the law say otherwise.
  • On marketplaces such as Kidz and Boss, the sale is between the buyer and the seller. We provide the platform, but are not the seller unless we say so.

6. Third-party services

The Services work with third parties such as WhatsApp, Google Play, the Apple App Store, payment providers and sign-in providers. We are not responsible for their services, and their terms apply when you use them.

7. Our intellectual property

The Services, including software, designs, logos and the names Gildartz, Kidz, Waku, Boss, Prcl, PTA, Billz, SpyProp and Linopot, belong to Gildartz or our licensors. These terms give you a limited, personal, non-transferable right to use the Services, and no other rights.

8. Changes and availability

We work to keep the Services available and reliable, but we do not promise they will always be uninterrupted or error-free. We may change, suspend or discontinue a feature or product. If we discontinue a paid Service, we will give reasonable notice and refund any prepaid fees for the unused period.

9. Suspension and termination

You can stop using the Services and delete your account at any time. We may suspend or close your account if you break these terms, if the law requires it, or to protect other users or the Services. Sections 4, 7, 10, 11 and 13 continue to apply after your account is closed.

10. Disclaimers

The Services are provided "as is" and "as available". To the extent the law allows, we make no warranties beyond those set out in these terms. Information shown in the Services, such as property data in SpyProp, is for general reference and is not professional advice. Nothing in these terms limits rights you have as a consumer under Malaysian law, including the Consumer Protection Act 1999, that cannot be excluded.

11. Limitation of liability

To the extent the law allows, we are not liable for indirect or consequential losses, or for lost profits, revenue or data. Our total liability to you for any claim about the Services is limited to the amount you paid us for the Service concerned in the 12 months before the claim, or RM100 if you paid nothing.

12. Changes to these terms

We may update these terms. We will post the new version on this page with a new effective date, and tell you about important changes through the Services or by email. If you keep using the Services after the change, you accept the new terms.

13. Governing law

These terms are governed by the laws of Malaysia. Disputes will be handled by the courts of Malaysia.
